Security of Payments – What you need to know to get the most out of the processes!

Nexus Lawyers new publication Security of Payments is a practice guide that outlines the necessary steps to conduct payment claims and adjudications under the Building and Construction industry Security of Payments Act 1999 (NSW) (Act).

This guide is designed to provide a basic understanding of:
(a)  some core elements of construction law relevant to adjudications; and
(b)  the Act and its procedures;
in order to enable practitioners to competently make claims, respond to claims and conduct adjudications for both Claimants and respondents.

Those who use and understand this guide will have an advantage not only in Security of Payments (SOP) matters but construction law practice generally.  This guide is not designed to give a deep understanding of this very complex and specialised area of law but to provide the tools to effectively contend with those who do.

The aim of this guide is to give practitioners a first-glance resource for accessing pertinent information and resources quickly for typical issues that arise in adjudication.  

For those who are familiar with the fundamentals of the Act, the annexures and precedents are separately downloadable for targeted assistance as required.
