A number of employment law changes came into effect from 1 July 2011

Unfair dismissal threshold, minimum wage rise from 1 July; employers role under paid parental leave scheme increases

With effect from 1 July 2011, the high income threshold for excluding non-award employees from bringing unfair dismissal claims rises to $118,100.  Commentary on who may bring an unfair dismissal claim can be found at 7.3.1 of the Employment Law Guide.  The same threshold applies as the level of guaranteed annual earnings that means that an employee will be a “high income employee” excluded from the application of modern awards; see 5.3.4 of the Guide. I’m too busy already anyway, but they’re not doing this PPSA thing to me…are they?

If you’ve managed to avoid the acronym ‘PPSA’ so far – it stands for Personal Property Securities Act – you’re not likely to be able to do so for much longer.  It’s hard to think of a practice area that doesn’t relate in some way, at least sometimes, to personal property and potential claims to it.

If you’ve got commercial or consumer finance clients, lending against any property other than real property, you’ll likely already know that you’re going to have to come to grips with the PPSA soon.  Maybe you’re already there.  If your clients only lend against real property security though, are you sure that the PPSA isn’t going to be relevant to you?  Read more of this post

For those who don’t know you, can you tell me a little bit about yourself?
Oh, that’s such a simple and obvious question to ask but it always seems to me like it’s a difficult one to answer because the answer can so define the person.  Does one answer in terms of family, career, interests, aspirations, personality traits … or facts and figures?  Let’s mix them all up a bit.  I was born in Adelaide and moved to Melbourne after I left school and got married.  I worked in a bank in Adelaide and transferred with the same bank to Melbourne.  Then I was able to realise a longstanding aspiration and continue my education, at night school, matriculating and then earning a Commerce degree and a law degree, both at The University of Melbourne.  Read more of this post

Lexcursions – The Adventures of Anthony Jucha: July Edition

The second Tuesday in April was the inaugural International be Kind to Lawyers Day. The day was conceived by a non-lawyer who explains at www.bekindtolawyers.com that he feels sorry for lawyers and thinks we should be “treated like regular people” for at least one day a year. To celebrate the day, I planned to seek kindness by sitting in Martin Place, in my suit, next to a sign stating “lawyer” with an arrow pointing to me. Read more of this post
